Shipping Policy

SHIPPING POLICY-AVIATION PRODUCTS AND SERVICES

1. Purpose and Scope

This Shipping Policy governs all shipments of aviation parts, components, materials, and related services supplied by Desert Jet Aviation (“Supplier”) to its customers (“Buyer”). It applies to all domestic and international deliveries, including standard, expedited, and AOG (Aircraft on Ground) shipments, unless otherwise agreed in writing. This Policy forms an integral part of the Supplier’s Terms and Conditions of Sale.

2. General Shipping Terms

All shipments are made Ex-Works (Incoterms 2020) from the Supplier’s designated facility unless otherwise stated in the purchase order. Title and risk of loss transfer to the Buyer upon delivery to the carrier. Supplier reserves the right to select the mode of shipment, carrier, and route unless the Buyer provides specific written instructions prior to dispatch. All goods are shipped in compliance with IATA, ICAO, GACA, and other applicable civil aviation and export control regulations. Shipping timelines are estimates only and may vary depending on product availability, export documentation, customs clearance, or carrier delays.

3. AOG (Aircraft on Ground) Basis Shipments

‘AOG’ refers to emergency shipments required to return an aircraft to service due to an unplanned maintenance event, part failure, or operational grounding. Buyer must clearly mark purchase orders as “AOG” and notify the Supplier’s AOG desk by both email and phone. AOG orders are processed on a 24/7 basis, subject to stock availability and export release. Supplier will prioritize AOG shipments and arrange next-flight-out (NFO) or equivalent express handling whenever possible. AOG handling, after-hours processing, and express courier surcharges apply and are billed separately. Once dispatched, AOG orders are non-cancellable and non-refundable. Buyer is responsible for all AOG-related freight, insurance, customs, and regulatory fees. Supplier will exercise reasonable care to expedite AOG shipments but shall not be liable for aircraft downtime, loss of use, or consequential damages resulting from courier, customs, or regulatory delays.

4. Shipping Methods

Standard Shipping: Normal business-hour dispatch through approved carriers.
Expedited Shipping: Priority air freight with limited handling time.
AOG Shipping: Emergency dispatch with real-time logistics tracking.
Consolidated Shipping: Combined shipment of multiple orders to reduce freight costs, subject to Buyer’s approval.

5. Shipping Documentation

Each shipment includes: Commercial Invoice, Packing List, Certificate of Conformity / FAA or EASA Form 8130-3 (if applicable), and export declaration or permits as required by law. The Buyer shall ensure that all import licenses, end-user certificates, and destination approvals are obtained prior to shipment.

6. Shipping Costs and Charges

All freight, handling, insurance, and customs clearance costs are borne by the Buyer unless agreed otherwise. Additional charges apply for re-routing, re-delivery, or special packaging requests. Any incorrect shipping information provided by the Buyer resulting in cost overruns shall be chargeable in full.

7. Customs and Import Duties

The Buyer is solely responsible for all import duties, taxes, and brokerage fees applicable in the destination country. Supplier shall not be responsible for delays or penalties imposed by customs authorities.

8. Insurance

Unless expressly requested and confirmed in writing, shipments are not insured by the Supplier. Buyer assumes full responsibility for loss, theft, or damage during transit if no insurance coverage is arranged.

9. Delivery Timeframes

Standard: 5–10 business days (subject to carrier availability)
Expedited: 2–5 business days (priority handling)
AOG: Same day or next flight out (24/7 availability depending on clearance)

10. Damage or Loss in Transit

Buyer must inspect all shipments immediately upon receipt. Any loss, shortage, or visible damage must be reported to the carrier and the Supplier within 48 hours of receipt. Failure to report discrepancies within this period constitutes acceptance of goods as delivered in good condition.

11. Export Control and Compliance

Supplier complies with all applicable Saudi, U.S., and international export control laws, including ITAR, EAR, and GACA regulations. Buyer agrees not to re-export, resell, or transfer goods in violation of such laws. Supplier reserves the right to withhold shipment pending export approval or compliance verification.

12. Force Majeure

Supplier shall not be held liable for failure or delay in delivery due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, acts of war, embargoes, epidemics, or carrier disruptions.

13. Returns and Restocking

Returns require prior written authorization (RMA) from the Supplier. Non-defective goods are subject to a restocking fee of up to 25% of the item’s value. AOG, custom-fabricated, or special-order items are non-returnable unless proven defective under warranty.

14. Governing Law and Jurisdiction

This Policy and all shipments shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute shall be subject to the exclusive jurisdiction of the Commercial Courts in Jeddah, unless otherwise agreed in writing.

16. Legal Disclaimer

The information in this Shipping Policy is provided for general guidance and does not constitute a binding commitment unless incorporated into a signed contract. The Supplier reserves the right to amend, revise, or update this Policy at any time without prior notice. While all reasonable efforts are made to ensure accuracy, the Supplier disclaims any liability for typographical errors, pricing discrepancies, or third-party courier delays. Under no circumstances shall the Supplier be liable for indirect, incidental, special, or consequential damages, including but not limited to aircraft downtime, operational losses, or lost profits arising from shipment delays, misrouting, or product handling. The Supplier’s total liability for any claim arising from or relating to shipping shall not exceed the purchase price of the goods shipped. By placing an order, the Buyer acknowledges and agrees to be bound by this Shipping Policy and its disclaimers.

Annex A – AOG Response Commitment Timeline

The Supplier commits to the following AOG response standards:
- Acknowledge AOG request within 2 hours of notification.
- Confirm part availability and quotation within 4 hours.
- Dispatch parts within 24 hours of confirmed purchase order and export clearance.
- Provide continuous shipment tracking and logistics updates to the Buyer until delivery.

Annex B – Dangerous Goods and Lithium Battery Handling Clause

All shipments containing dangerous goods (DG), including but not limited to lithium batteries, chemicals, or pressurized containers, shall be packaged, labeled, and documented in accordance with IATA Dangerous Goods Regulations (DGR). Buyer must notify the Supplier at the time of order if the product is classified as DG. The Supplier reserves the right to reject any shipment that does not comply with DG handling and transportation laws.
